First article : Application field
Sales Terms concern exclusively current and future commercial relations between Mustradem (us) and the person placing the order (you). Any condition formulated by you, not corresponding to our terms, would be rejected unless we specifically accept its applicability, in writing.
We can modify these Sales Terms at any time, given that we publish any modification on our site.
Second article : Orders
We undertake to accept your order under the conditions of these Sales Terms. Please note that we will respond to your order, subject only to our current available stock, here or at our suppliers.
When you order, we inform you of the availability of the articles you wish to buy. Nevertheless, if the articles are temporarily unavailable despite our meticulous attention (e.g. out of stock, new issues...etc), after your order has been placed, we will inform you by email and will invite you to cancel or modify it.
If the articles become definitively unavailable (sold out, no longer available...etc) after your order, we will automatically cancel it and inform you by email.
When you confirm your order, you accept the entire Sales Terms, as displayed on our site, and acknowledge that you are completely au fait with them. You thereby renounce imposing any contradictory document, particularly your own buying terms. Buying implies accepting our Sales Terms.
This confirmation of purchase, together with your complete recorded personal data will constitute proof of our transactions.
Third article : Prices
The prices in euros include sales taxes, but exclude freight and processing costs. We reserve the right to modify our prices at any time but we undertake to apply current prices that will have been displayed when you ordered. Books are sold in respect of the "Loi Lang 81-766 du 10 Août 1981 sur le prix unique du livre". According to this law, price reductions cannot exceed 5% of the price decided by the editor or the importer, apart from exceptions specified by the same law. If, despite our meticulous attention, the publisher or the importer had just increased the book price, we undertake to notify you of this change before sending the book and to automatically apply the reduction of 5% on the new price.
Please note that prices, which appear on the site when you place your order, are given in euros. It is possible, for information, to display other currencies (US dollar, CHF, British Pound...etc). The exchange rate shown is the one from the previous day. This exchange rate could be different from the one used at time of billing.
Neither Mustradem nor any of its affiliated companies is liable for errors in the conversion system used. Nor for any differences which could occur between the total estimated price of your order and the total of the bill.
Fourth article : Payment
The total price is payable immediately from the time of order. You can make your payment by :
- Bankcard : cards issued by banks resident outside of France must be international bankcards. Payment online by bankcard is safe. It is done by ATOS and "Crédit Mutuel", the latter known for its reliability in the field of secure transactions. It uses SSL (Secure Socket Layer) protocol. All transmitted data is coded by software and cannot be read during their passage through the network. Mustradem holds no banking data.
- Cheque : Payment by cheque is only possible for cheque in euros from banks resident in France or Monaco. The order will only be sent after reception of the cheque written out to Mustradem and sent to the following address :

Fifth article : Delivery
Except for arrangements to the contrary, the delivery is made to the address you indicated at the time of order. Any risks are yours from the date at which the ordered articles leave our premises. Delivery times are only an indication and are the responsibility of the courier. In the eventuality where you chose to pay by cheque or direct credit, the order will only be processed at reception of payment and delivery time will be affected accordingly.
15 days after shipping for France or 21 days outside mainland France, orders take on a delivered status. They are considered delivered and accepted as such, any complaints or requests for refund because of non-delivery will not be valid.
Sixth article : Returns and refunds
All our articles carry the manufacturer¹s guarantee, and are identical to those found in other retail outlets. Any article returned for exchange within a 10-day period from the date of reception of order (with indication of bill number) will be exchanged without penalty. Freight back and forth will nevertheless be invoiced to you except if the return is due to a mistake on our part. Only articles returned complete, in good order and in their original packaging (books, CDs, cellophaned items unless faulty) will be refunded or exchanged.

At the end of the 10-day period, the articles will be deemed to be corresponding to your order and accepted by you.
Seventh article : Property rights
The products shipped remain our property until you have fulfilled your obligations, and especially until complete payment of the full price, which could also include any interests accumulated.
These property rights do not obstruct the transfer of cost of any risk to the buyer, which will be yours from the date the ordered articles leave our premises, as detailed in the fifth article of these Sales Terms.
Eighth article : Responsibility for hidden defects; guarantees
In the event the articles we delivered present a hidden defect, we can either eliminate this defect or replace the defective article by another one. This is at our discretion.
If we do not want to either replace the defective article or repair the defect, or if it is impossible for us to do so, or if we cannot do it in time because of factors independent of our intentions and actions, you can either send it back to us to be reimbursed (full price and return freight) or ask for a reduced sale price, whichever you chose.
Articles for sale all conform to current French legislation. We decline any responsibility if any article delivered does not correspond to legislation in the country of destination (e.g. censorships, prohibition of author or book). In addition, we will not be held responsible for the content of any site linked to ours. We undertake to give all attention usually offered in this profession to put into practice services offered to clients.
Nevertheless, we will not be held responsible if we cannot fulfill our contractual obligations due to unpredictable events such as catastrophes, strikes, fires and floods, faulty or broken down material, transport or communications problems or because of your actions.
In addition, we will not be held responsible for lateness due to de-stocking at the publisher or the supplier, nor in case of errors in the representation of any articles on our site, photography, texts and illustrations presenting non-contractual articles.
Ninth article : Personal data security
We undertake to protect your personal data. All personal data we have gathered is treated with the strictest confidentiality, in accordance with the terms of our personal data protection policy.
When you buy, we only ask for the minimum necessary information to assure the quality of our service and the processing of your order. We do not sell nor commercialise, nor rent this information to anyone else. If you do not want to receive our email information, go to "My account" and make the desired modifications (if you possess several accounts, remember to modify each one of them). In application of "l'article 27 de la loi Informatique et Libertés du 6 janvier 1978", you have access and can rectify your personal data. To do this, you go to "My account" via your email address and password. For any other enquiry about your personal data security, you can contact us directly.
Adhering to these Sales Terms, you acknowledge being au fait with our personal data security policy, and also us collecting and using your personal data.
Tenth article : Relevant laws and competent jurisdiction
These Sales Terms are subject to French laws and the Vienna Convention on international merchandise sales contracts (excluding "droit de la vente des Nations Unies").
Any litigation concerning the commercial relationships between you and us will be handle by the relevant French judicial competency. |
